Supreme Court Hears Arguments in Case Challenging ACA Mandate for Free Preventive Care Services

A recent Supreme Court case is challenging access to free preventive care screenings for millions of Americans under the Affordable Care Act (ACA).

On April 21, the court heard oral arguments in Kennedy v. Braidwood Management, Inc., questioning the authority of the U.S. Preventive Services Task Force (USPSTF) to determine what preventive care services should be covered at no cost under the ACA. If this ACA provision is overturned, anything the USPSTF has recommended since 2010 would no longer be covered at no cost.

Supplemental letter briefs from both parties are to be filed by May 5, and a decision is expected by June or July. When hearing oral arguments, the justices seemed likely to uphold the USPSTF authority (see a transcript of the proceedings here).
