On Nov. 16, President Biden signed a continuing resolution (CR) into law that would continue fiscal year (FY) 2024 appropriations and extend funding for expiring programs.

The CR sets two separate deadlines for Congress to pass all FY2024 appropriations bills. It funds several agencies, including the U.S. Food and Drug Administration and Veterans Affairs through Jan. 19, 2024. Most other agencies and programs will be funded through Feb. 2, 2024.

Protecting Access to Medicare Act Medicare cuts to the Medicare clinical laboratory fee schedule have been delayed by one year, buying Congress time to pass the Saving Access to Laboratory Services Act (SALSA). SALSA would grant the Centers for Medicare & Medicaid Services the authority to collect private market data through statistically valid sampling from all laboratory segments, in particular for test services for which previous data were inadequate.

Additionally, data reporting for clinical laboratory diagnostic tests that are not advanced diagnostic laboratory tests will not be required until the end of calendar year 2024. Reporting will be required from Jan. 1, 2025, until March 31, 2025, and is required every three years thereafter.
