Update 12/10/21: On December 9, the Senate passed legislation to delay for one year the next round of cuts to laboratory reimbursement and the associated private-payer data reporting period scheduled to begin on January 1, 2022. The House passed the legislation on December 7, 2021, and President Biden is expected to sign it.

Additionally, The Protecting Medicare and American Farmers from Sequester Cuts Act impacts payments for all Medicare Fee-for-Service (FFS) claims:

No payment adjustment through March 31, 2022
1% payment adjustment April 1 – June 30, 2022
2% payment adjustment beginning July 1, 2022

Update 12/09/21: Late on Tuesday, December 7, 2021, the House of Representatives passed legislation that would delay PAMA cuts and private pay data reporting obligations for one year, until January 1, 2023. The legislation now heads to the Senate where it must garner 60 votes to avoid devastating reimbursement cuts to laboratories. The Senate is expected to vote on this legislation on Thursday or Friday, December 9 or 10, 2021. If the Senate passes the legislation and the President signs it, PAMA-related reimbursement cuts and reporting obligations will be delayed until January 1, 2023, giving Congress more time to pass a permanent fix to PAMA. Congress reached a deal to delay PAMA cuts to the Medicare Clinical Laboratory Fee Schedule and the next private-payer data reporting period for one year. Both were to go into effect on January 1, 2022.

The National Independent Laboratory Association (NILA) asks laboratories to help ensure the urgent need to stop the forthcoming PAMA cuts by calling their Senators.
